Social media monitoring for strategic business decisions

There?s nothing like 30 Rock satire.

When I started talking at Social Media Explorer?s inaugural Explore event for social media marketers in Dallas last week, I wasn?t sure if the concept of using social media exclusively to listen for business strategies was too simple, too advanced or too boring.

30 Rock to the rescue.

For example, there?s sweet Kenneth.

There?s a reason God gave us two ears and only one mouth: listening is twice as important as talking. But he gave us ten fingers ? he must really want us to poke things! ? Kenneth, 30 Rock

There?s actually a lot of insight we can extract for this quote. First, there?s the difference between how real people think and how marketers think, especially when it comes to social media.

Here?s how real people think: Stop poking into my private conversations, unless I ask for your help. (Yes, their conversations are happening publicly, but behind a computer monitor or on a smartphone it seems private. Only the best intrusion marketing is effective. And by the best, I mean it never feels intrusive.)

Here?s how some social media marketers think: I can hear your conversation, and even though you didn?t ask, I can help! And so they poke-poke-poke with all 10 fingers and type away a response.

In fact, for some companies this is the extent of social media marketing: customer service. A customer complains on Facebook or Twitter, and the marketer handles the complaint.

But let?s go back to Kenneth?s advice: ?Listening is twice as important as talking.? For some businesses and industries, I would argue that it can be twice as important as handling customer service via social media. Why? Because good social media listening can happen everything people are being social online. Because it affects multiple business needs. Because it can more quickly and directly affect your bottom line.

For this kind of advanced strategy, there are three things to consider:

  1. It?s proactive, not reactive.
  2. It drives better business decisions, faster.
  3. It requires thought and time, not necessarily expensive tools.

1. It?s proactive, not reactive

For the companies where social media monitoring begins and ends at customer service, they?re doing something important?but, still, it?s being reactive, not proactive.

Advanced social media monitoring is about listening?not just reacting?and then making decisions to act about what you have heard.

There are two simple proactive strategies to get you started.

Strategy: Monitor more than vanity words

First up is this one.

What do I mean by vanity terms? Well, not exactly what Jenna means?

Listen up Fives, a Ten is speaking. ? Jenna, 30 Rock

?but it?s not too far off.

A vanity keyword is any word that you?re monitoring because your boss or your client said so. It?s an ego thing. They want to know how often they?re mentioned, perhaps by name, even though they?re doing nothing with that information and keeping track does nothing for their bottom line. In fact, it might cost them money (i.e., to hire you) and time.

Sometimes monitoring vanity terms are ok?you might, again, want to stay ahead of a crisis?but Smart Ears are listening for opportunities.

Business need: Publicity

For example, let?s say your business strategy is to get more media publicity. Is someone on staff an expert? Do you want to be quoted in traditional media? You?re doing PR outreach and are having some success, so you set up a search and sit back and wait and see where they?re being mentioned ?

But for this business strategy, you could be a little bit smarter and set up a search for the type of expert you have, and the source you want to be quoted in. Find out who else is being quoted, and where. See who the publicity competition is, and reach out to them. Reach out to the person who interviewed them. That?s proactive social media monitoring.

Strategy: Go where your people are

This proactive strategy is near and dear to me. You see, when I say go where your people are, I mean your customers and potential customers?NOT your peers.

We all like validation from industry professionals, but too much time in the echo chamber means we just parrot each other instead of coming up with creative idea. (More on independent thinking later.)

Also, your people may not be on Facebook or Twitter. Your people might be on forums, bulletin boards, Google Groups, LinkedIn, YouTube, community groups: anywhere that people are being social online.

Business need: To save time

Let?s take Bob The Mechanic, who has an auto supply business on the side. Where are Bob?s people?

Lots of auto enthusiasts are on Facebook and Twitter, sure. But for Bob The Mechanic, the day-in-and-day-out management and monitoring for certain words on Twitter or Facebook may do him far less good than just reading and regularly participating in forums for the kinds of cars that he repairs. Why?

Because Bob knows there are tens of thousands of people comments in those forums that he can ship parts to. He knows they?re already enthusiastic, engaged and excitable just by being there. And while they may be DIYers, even if all Bob gives them is good advice, he?s becoming an expert in an influential community?that of potential customers.

mazda-forums

Bob may even be able to subscribe to an RSS feed for the most relevant posts, saving him even more time.

2. You can make better business decisions, faster

When it comes to saving time, for example, you want to make the best possible business decision in the least amount of time. Dither too much and you might waste opportunities ? or problems can build. If you have Smart Ears, you can gain real insight into what people think of your business or product sooner than you would have normally. Then you can use that insight to make decisions about your business.

Strategy: Use the words customers use

The first example we?ll look at for faster business decisions is related to marketing. Why use jargon, or waste money on mega focus-groups, when your existing customers can describe your product and brand for you? Some call this User-Generated Content, but you can just call it ?words real people use.? (You know, like words that real people would use.)

?Remember everyone, just don?t be yourselves.? ? Jack, 30 Rock

Why is using words real people use even better? Because when customers describe YOUR product, they?re talking about what THEY love, not you. In a way, it?s like being your own customer. There are some great companies using this strategy now.

Business need: marketing copy/slogans

In fact, it?s as old as those Zagat guides. Remember those? The survey-based restaurant guides that used actual quotes from customers? They went to the trouble of expensive surveys to extract single words or short phrases such as ?excellent,? ?casual? or ?great for a family dinner.? But you don?t have to conduct expensive surveys. You can mine forums, feedback via email, comment cards, testimonials or conduct an inexpensive survey to find those real words for your marketing campaigns.

ModCloth is a young woman?s B2C clothing website. If I could sum up their products in a few words it would be ?modern,? ?cutesy? and ?expensive.? But what do ModCloth customers themselves actually say? Well, ModCloth used its customer reviews to find out?

modcloth1

?then they used some of that identical copy in their email marketing campaigns.

modcloth2

They even created additional content?a Style Glossary?to keep buyers on their website and keep them engaged enough to buy more of those super darling clothes.

Will customers always say exactly what you want to hear?

?There?s some back and forth between what words customers are using and how you want to be known,? said Maura Ginty, Senior Manager, Strategic Research and Innovation at Autodesk, at DreamForce 2011. But ?understanding the how customers see things is important.?

Generally, listen to and trust what the customer is saying to guide your decisions, and wherever possible, use their words.

Strategy: Teach the way customers prefer

When you?re really listening to customers, you?ll be able to pay attention to how they learn.

Let?s say you want to start a training program, but you aren?t sure what kind of content works best. Or let?s say you have a product that?s a little complicated, and you?re doing a little of this and a little of that, but you don?t know what is ?sticking? best.

Some companies have listened well enough to figure out that video works best. Here?s how:

Business need: Training

How many of you have smartphones? Do you have a protective film on that phone? Chances are it?s invisiSHIELD, a product by a company called ZAGG. ZAGG already is a marketing powerhouse?especially their online marketing department?I advise you to sign up for their newsletters and emails and mine them for ideas. On Twitter, they?re @ZAGGdaily.

But ZAGG has been branching out from their original product line into smartphone and tablet accessories, and they needed to teach customers how to use their more technical products. They started with traditional copy on the web, but then something interesting happened.

?ZAGG was getting mentioned on Twitter in reference to our video content a lot more than our other content, with no added promotion on our part, so we knew what people were really getting excited by,? said Scott Cowley of Zagg?s Internet marketing department.

So they recorded some simple videos, posted them to YouTube, promoted them on their website and in their email newsletters?and watched sales climb!

Why? Because they were listening with Smart Ears to which method of learning was getting customers excited. People wanted to learn by video? and how much easier is it to watch video on our faster and faster smartphones these days?

Sony did the exact same thing. In fact, they draw a direct line from social media monitoring to ROI.

Except, like most large companies, they hired an expensive outside firm to listen for a year for them to discover that people liked to learn how to use a computer with one-on-one-feeling video instruction (go figure). So they set up a SonyListens YouTube channel for this content?and they cross-promote under various accounts on YouTube.

And besides the basic tech help, Sony is helping people learn to do the things they want to do with videos like ?How to make a funny video of kids.?

sony-funnyvideo

Help people do what they want to do, and you?ll be ranking on top in no time.

Strategy: Verify product decisions

But what if your product isn?t ranking so well? What if you have made a decision and you?re not sure whether it was the right one? Careful listening can guide you to the right correction.

Business need: Product problem-solving

Take Crave America restaurants, for example, which was expecting higher sales of a new signature cocktail. They did some social monitoring and found that people were using the word ?peppery? or ?too spicy? to describe it. It turns out that the jalepenos varied from batch to batch and using the exact same amount each time wasn?t right?the bartenders needed more control. The chef tweaked the recipe and sales jumped. This is just another way to see trends and patterns?because people are far more honest to their friends about their likes and dislikes than they are to a random brand.

Strategy: Beat competition to market

In that case, social media listening helped the restaurant identify the problem. Social media listening can also help you identify the opportunity?especially when it comes to beating the competition to market.

Business need: Opportunities identified

Let?s say you?re Maria, an upscale Dallas manicurist. Maria wants to stand apart from the crowd when it comes to nails. Maria keeps up with trends in magazines, but she wants to come up with something creative a little sooner than once a month. She?s noticed that nail art is huge on Pinterest, so when the Golden Globes rolls around, she pays attention to celebrity nails in real-time.

The most talked about? Zooey Dechanel?s tuxedo-cure.

zooey-nails

But what do the actual potential clients think? Do they like this look? Maria reads the comments for a clue on this article?s forum and elsewhere. The general consensus: adorable, but unprofessional-looking. Cue Maria! She could send a ?get the look? email to her clients for an instant lift.

Or? Maria could be a little more proactive, do a little more critical thinking, and offer a DIY nail art series. DIY may seem counterintuitive, but once you?re a woman addicted to a look, you?ll do anything to have it.

3. It requires thought, time and tools

So for Maria, the business need of social media monitoring was all about thinking about the opportunities. For Bob the mechanic, it?s thinking about where to spend his time. For the restaurant, it was problem solving. For ModCloth, it was finding the right marketing words. For Zagg and Sony, it was about finding the right training technique. And for anyone, it could be publicity.

And while it could be good to brainstorm with others, it?s thinking independently that will help you stand apart with the strongest ideas.

In other words, don?t be Liz Lemon.

?So what?s your religion, Liz Lemon???Tracy. ?I pretty much just do whatever Oprah tells me to do.? Liz, 30 Rock.

Don?t be Tracy Jordan, either, but don?t be Liz Lemon.

Postscript: Social media monitoring tools

I wasn?t surprised when someone from the audience asked about great tools to do this. Besides, of course, Raven?s nifty Social Monitor and Social Stream tools, our Community Manager Courtney Seiter has a great crib sheet that you can use. Here?s her presentation on the subject.

(AP) ? A fire broke out Monday in the generator room of an Italian cruise ship, leaving it adrift off the Seychelles in the Indian Ocean, but causing no casualties, officials said.

The accident aboard the Costa Allegra occurred about six weeks after the Concordia, another Italian cruise ship owned by the same company, capsized off Italy, killing 25 people and leaving seven missing and presumed dead.

Asked about Monday's Costa Allegra accident, Italian Coast Guard Cmdr. Cosimo Nicastro told SkyTG24 TV that the ship's captain told Italian authorities the blaze was quickly extinguished.

"The passengers are fine," Nicastro said. But the fire left the cruise liner "without propulsion," meaning the ship, with 636 passengers and 413 crew members aboard, was adrift in the sea because the engines weren't working, he said.

But "the fire danger is over," Nicastro said.

Costa Crociere SpA, which is based in Genoa, Italy, said in a statement that its ship was about 20 miles (12.5 kilometers) from Alphonse Island, one of the atolls in the Seychelles, a nation of islands and atolls that is a popular tourist destination.

Officials said coast guard boats and an aircraft were being sent to the disabled ship.

Costa Crociere said in a statement that after the fire began in its Costa Allegra's electric generator room, "the special firefighting units intervened to extinguish it.

"The fire did not spread to any other area of the ship. There were no injuries or casualties," the statement said. It did not say what caused the fire.

The cruise company said that a general emergency alarm was "promptly sounded" as a precaution, and that all passengers and crew not involved in the emergency reach muster stations.

After the Concordia cruise ship struck a reef off Italy's tiny Tuscan island on Jan. 13, its captain was arrested and several other officials were placed under investigation. When the Concordia listed to one side, many people hadn't been evacuated on life boats and some jumped into the sea. Concordia passengers said that the order to evacuate came about an hour after the ship was speared by the reef and started taking on water.

On Monday, Italian coast guard officials dispatched cargo ships near the Costa Allegra to help.

The Seychelles coast guard and air wing mobilized, and an aircraft was flying over the ship late Monday evening, said Seychelles presidential spokeswoman Srdjana Janosevic. The island's port authority sent two tugs to the stricken ship.

"And there are fishing vessels in the vicinity, large ones, that are going to provide support as well," Janosevic said. "They have assistance coming to them.'"

The Allegra had left northern Madagascar, off Africa's southeast coast, on Saturday and was cruising toward the port of Victoria, Seychelles' capital, when the fire erupted. Costa said the Allegra had been due in Victoria on Tuesday.

The Allegra was built in Italian shipyards in 1992, is 188 meters (615-feet) long, has eight passenger decks and 399 cabins.

Stock Ranking According To Hedge Fund Investing (Part 4 ...

<< Return to Part 3

Hedge funds and institutional investors must publish their investment activity each quarter for all the world to see. There are many websites which will give you access to various degrees of this knowledge for your potential gain. What I am sharing is my personal belief about how best to use this information. The two main factors I use are as follows:

1. Net Market Value Bought. This is the total market value of an individual stock purchased by the professionals less any market value sold. Obviously larger is better, as it shows that a great deal of money was bought in that stock vs. sold. Each quarter I rank stocks and assign them a score from 0-100%, with 100% representing the largest market value bought stock, and 0 the worst. I do the same scoring for the 2nd factor:

2. Price drop as % (relative to global stock index). Since our information is delayed by approximately 45 days, and also the 3 month quarter, I subjectively select the most likely average price that each stock would have been purchased at by the pros, calculate the change from that price as a percentage, then assign a score from 0-100%, where 100% is a stock that has dropped by the most. The bottom line is that I prefer getting a stock that's gone down 20% vs. one that has gone up 20%, since I'm getting a better value for my purchase price. I throw out many stocks that clearly have already taken off to the upside. I'm not a trend follower. I seek stocks that I can buy cheaper than the pros have.

As I've disclosed in previous articles, the following chart shows my purchases using an imaginary $300,000 portfolio, and 1% per position resulting in amounts centered around $3,000. I simply invest more or less than $3,000 in accordance with how well the stock does in the two factors listed above. I then compare the returns I get vs. those I'd have gotten in the Vanguard Total World Index (VT).

New buys for this quarter are in bold. You'll note that several stocks have seen significant enough net market value sold that I've decided to sell from my portfolio (and therefore this portfolio). The following table shows the overall results of the entire portfolio:

net alpha all: $4,506.78
stock return: $10,209.93
stock return%: 8.39%
index "VT" return%: 4.69%
net alpha %: 3.70%

In conclusion, the system continues to beat the world stock index soundly by a little under 4% overall. We are, however, still very dependent on the huge alpha generated by MMI. My confidence in the system remains extremely high, due not just to the portfolio beating the world index, but also the subjective data sampling that I take.

For instance, in looking through stocks where a lot of market value has been added, it's uncanny the consistency with which these stocks have exploded upward. This past quarter for example, more market value was purchased in AAPL than in all the stocks I purchased put together. In other words, hedge funds bought Apple like mad, but they did so at a much lower entry price than in presented to us right now: AAPL traded around $388 for much of the 4th quarter 2011. It's at $512 right now, a 32% increase vs a market increase of about 10%. Our delay inhibits our ability to follow hedge funds in stocks at their entry price, but also subjectively gives me confidence in the system.

Disclosure: I am long GOOG.

Additional disclosure: I am long every stock mentioned in this article with the exception of the stocks listed with sold dates in the table. I am long: SLB, WFC, COP, GOOG, AAPL, CVX, JPM, PFE, DIS, COV, TEL, C, CTL, CSX, MDT, ESRX, V, LVS, VTR, BRK.B, BXP, BIDU, MSFT, PCLN, ECL, SNDK, VIV, MON, ABT, CMVT, LMCA

After creating the lead conditions, a company?s marketing rep must know their lead source. He must be able to identify the particular sources of prospects and be able to begin using these efficiently and effectively for you to routinely develop leads and also continuously up-date the sales opportunities list they will currently have.

If a company determines to hire their own team involving lead phone callers, they must be willing to train their particular staff about phone social grace, identifying your prospects as well as their questions as well as issues about the service offered. Also, an organization must be able to put up a dentist?s office specifically designed for your lead generation telemarketers. They should also gadget a fool-proof product sales script whose pitch sounds personal but still has an portion of sales and marketing integrated.

When engaged in their own to generate leads campaign, a business may also notice fit to obtain their own computerized responder, such as Live Speak, wherein prospective client customers may possibly leave request messages when they are unavailable to contact you via the phone. They might also depart their contact information herein to actually may be able to get back to them the moment a representative is accessible.

When outsoucring, Lead becomes more effective and practical as compared with maintaining you own private staff doing the job for you personally. For one, outsoucring lead generation business to business telemarketing is a cost-efficient option to an otherwise expensive restructuring of the office and the programs and software to be used within the campaign. Your client may simply join a month-long marketing campaign and has the choice to eliminate the partnership after the commitment or carry on the campaign for a longer time.

Additionally, the company are able to save on the costs of training which may otherwise be shouldered from the company when they decide to put by themselves team. Outsoucring Lead Generation promotions maintain their particular training team who have been performing lead strategies for years and therefore are therefore professionals on the themes of piece of software making, telephone etiquette as well as convincing strategies which will finally lead to a face-to-face session with a company?s sales representative.

Furthermore, telemarketing businesses provide clientele with standard progress reviews to make sure that the actual representatives responsible for their advertising campaign are carrying out according to their particular standards.

It is advisable to outsource qualified prospects generation needs to an established business to business telemarketing call center or perhaps outbound telemarketing firms because these companies have the latest technology and the greatest people to perform the campaign inside a manner which clients count on from their personal team.

Cover Yourself Or Risk Losing It All | Small Business Branding

In the small town where we live, there was once a pretty good family restaurant. Let?s call them ?Steed?s?.

Steed?s served seafood buffet ? the only one in town. The food was good and prices reasonable. While they weren?t exactly booked to the brim, they had a steady flow of customers daily. So they were profitable. Steed?s had also been there for decades. The family who owned it also owned several businesses in town and were quite reputable. Sadly, they are no longer in business and the reason had nothing to do with economy or big businesses crowding them out. What literally drove them bankrupt was a law suit.

Image via Wikipedia

The story was, a drunk driver coming out of their restaurant hit a bicyclist and killed him. Steed?s was found guilty of serving too many drinks to the driver.

This is truly tragic for both the bicyclist, his family and Steed?s. No matter what you personally think of the case and who?s at fault, the truth is, as business owners we must make an effort to cover our business or lose it all like Steed?s did.?Years of hard work, feeding the family and perhaps years more to come all gone.

Your website is no exception. We?ve learned that businesses have been fined $25,000 for not having a risk disclosure on their website. That doesn?t include the amount they had to spend in attorney fees.

That may be small change for some businesses but we know of many who exist online are bootstrapping start ups or the mom or dad setting up shop to put food on the table who do not have easy access to such sums of money. Not counting the emotional stress. This is certainly an experience neither of us wants whether we can afford the fees or not.

The solution in easy. Go to an attorney to have these documents drafted. Unfortunately, your attorney may not be well versed with Internet law and if they were, their fees aren?t likely to be attainable for the average start up or family business. That?s where we found ourselves years ago.

Then, we discovered AutoWebLaw,?put it to use immediately and continue to do so on every site we own. You can see the links to these documents in this site?s footer. If you?d like to get your hands on AutoWebLaw, you?ll be pleased to know it is quite affordable and you can get it right this very minute. We did it some time in 2005 and have never regretted it once. It gets used every time a new site is set up which is quite regularly. The nice part is finding new and updated documents for life. Just like the time when the FTC began cracking down on affiliate marketing, the documents were updated to reflect that and boy were we thankful.

And yes, by the way we are recommending this as an affiliate because we like, use, believe in it and think you should too. Consider using AutoWebLaw before it is too late.

Company claiming iPad trademark sues Apple in US

(AP) ? Apple Inc. is facing yet another challenge to its use of the iPad trademark in China ? this time in a court in California.

Proview Electronics Co., a unit of Proview International Holdings, which claims it owns the iPad name, filed a lawsuit against Apple's use of the trademark in mainland China at the Santa Clara Superior Court on Feb. 17, Proview spokeswoman Alice Wang said Friday.

An attempt by Proview to win an injunction to stop Apple from selling iPads in Shanghai was foiled this week when a court there rejected the case pending the resolution of a similar lawsuit in a higher court in China.

Apple had no immediate direct comment on the California lawsuit.

The companies are feuding over whether Proview sold the mainland Chinese rights to the iPad trademark to Apple in a 2009 deal.

Proview claims the sale of the iPad China trademark to a company representing Apple by its Taiwan affiliate in 2009 was invalid. Proview has not challenged the sale of other worldwide rights to the iPad trademark to Apple in the 35,000 British pound ($55,000) deal.

Apple contends that Proview included the mainland Chinese trademark in the sale and says it violated that contract by failing to transfer the trademark rights to Apple.

Proview's lawyers have indicated their company is open to settling its claim to the trademark. In the meantime, the two sides have engaged in legal skirmishes in Hong Kong and in southern China's Guangdong province, where Proview's main office is based.

There, lower courts have sided with Proview in two cases. The Guangdong High Court is due to hear Apple's appeal of the first decision on Feb. 29.

Proview International Holdings was once one of the world's leading makers of computer monitors, with sales in 50 countries and more than 7,000 employees in factories in Taiwan and China.

But the company's main focus on manufacturing cathode-ray tube displays ? the boxy monitors that have since been replaced by LCD screens ? appears to have hurt its performance.

The company's website now says it makes LCD displays, LCD televisions and LED lights. But Proview is deep in debt and faces its shares being removed from the Hong Kong Stock Exchange.

The company developed what it said was an "iFamily" range of products, including iTV, iWeb and iPAD. It launched its iPAD in 2000, but unlike Apple's 2010 tablet computer, Proview's earlier version failed to hit the market sweet spot that might have made it a hit.

Proview has sought to have commercial authorities in many Chinese cities stop sales of Apple's iPad. In suspending the case being heard in Shanghai, Pudong District Court rejected a demand for an injunction to stop iPad sales in Shanghai, where Apple has three big stores.

Jury pool shrinks in Rutgers webcam case

The jury pool for the trial of a former Rutgers University student accused of using a webcam to spy on his roommate's intimate encounter with another man was cut Tuesday after the judge reviewed answers from questionnaires.

Just 85 potential jurors for the trial of 19-year-old Dharun Ravi remained by Tuesday afternoon. The judge and lawyers in the case agreed to eliminate about 100 members from the pool because of the views they expressed on the questionnaires.

Twelve people and at least two alternates will ultimately sit on the jury. It's not clear when the trial will begin.

Ravi is charged with 15 criminal counts. The most serious are two bias intimidation counts that accuse him of acting against roommate Tyler Clementi because he's gay. He also faces charges of invasion of privacy and tampering with a witness and evidence.

Clementi's story touched off a national discussion about bullying of young gays after he committed suicide in September 2010 by jumping off the George Washington Bridge, days after the intimate encounter.

Judge Glenn Berman said Tuesday that most of the roughly 190 prospective jurors who filled out questionnaires last week said they had heard about the case.

He dismissed those Middlesex County residents who indicated that they had made up their minds.

Roommate of gay Rutgers student reportedly sent him conciliatory texts

Also on Tuesday, Berman fixed an error that could have had an impact on the trial: A hindering apprehension charge was changed from a third-degree crime to a second-degree crime.

Normally, that technical change would mean that a defendant who's found guilty would likely face a prison sentence. But Berman said he could still view that charge as a third-degree crime for sentencing purposes if Ravi is found guilty of it. He said he would decide that issue later if he needs to.

Charged with invasion of privacy, not with death
Ravi has not been charged with causing Clementi's death. Instead the main charge is invading Clementi's privacy, which is unlikely to result in prison time for a first offender. For a hate crime conviction, which carries a sentence of up to five to 10 years, prosecutors must prove Ravi attempted to intimidate Clementi for being gay. Ravi also faces related charges of tampering with witnesses and evidence.

Ravi has pleaded not guilty to all the charges, and has rejected a plea deal with prosecutors that could have helped him avoid a prison sentence. Instead he now risks up to 10 years in prison if convicted.

"Most hate crimes are committed against strangers, not against roommates or against good friends or neighbors," Jack Levin, a professor of criminology at Northeastern University, said in an interview.

Successful prosecutions typically rely on racial or homophobic slurs made as the crime is committed, graffiti left at the scene, the possession of hateful propaganda by the offender, or an offender's previous history of hate crimes.

"In this case there apparently are none of those indicators to be found," Levin said. "It doesn't sound like a very strong case."

On Sept. 19, 2010, Clementi had arranged to have a man in his mid-20s identified in court only as M.B. to come over, and asked Ravi if he would leave the room. Ravi agreed. He went to the room of Molly Wei, a friend across the corridor, and used her computer to access his webcam through video-chatting software.

Wei later told investigators Ravi was alarmed at having to leave his room for a visit from an unknown older man and wanted to know what was going on. She said they saw images of Clementi kissing M.B., and, shocked, turned the video feed off within seconds. Ravi posted a message on his Twitter account:

"Turned on iChat and saw my roommate making out with a dude. Yay."

Defense points to Clementi's jokes
To secure the bias intimidation conviction, prosecutors will need to convince a jury Ravi invaded Clementi's privacy and that he did so to intimidate him because he was gay.

Ravi's lawyers have pointed to transcripts of Ravi's online conversations with friends showing that, after the gossip value of discovering his roommate's sexuality has apparently faded, he concludes that Clementi being gay is "no big deal."

Ravi's lawyers have said in court documents there is no evidence Clementi was intimidated by Ravi's actions. He was open about his sexuality with friends and had come out to his parents, according to Clementi's chat transcripts.

After learning from Ravi's Twitter post he had been seen on the webcam, Clementi said in an online chat with a friend he felt "violated" at first, but soon after joked about the incident, saying he found it "sooo funny," and laughed when the friend suggested it could be considered a hate crime.

Nonetheless, he filed a formal request to switch roommates and posted his concerns on an Internet forum for gay men, which prosecutors are likely to point to as evidence he felt intimidated.

Even after realizing his encounter with M.B. had been briefly viewed by Ravi, Clementi invited M.B. back to his room two days later and again asked Ravi to excuse himself, although this time he was careful to make sure Ravi's computer was unplugged.

How to baby-proof your home theater

By Sarah Cavill, Techlicious.com

We?ve all heard it: The clatter of the remote control hitting the hard wood floor. The grind of the disc tray on the DVD player being forcibly closed, often with something in it other than a disc. The gleeful laugh of a toddler that has our phone and is running away with it. Many issues, when it comes to protecting our technology or home theater systems are just annoyances, but others pose real danger ? for your child and your electronics.

Fortunately, there are many easy to use baby-proofing measures you can take to keep your new crawler or worse, your new climber, safe and sound while also protecting your technology.

Safety 1st

1. Secure your TV
According to the Consumer Product Safety Commission, between 8,000 and 10,000 children are treated in emergency rooms each year because of tip-over injuries, and televisions are major offenders. Flat-screen televisions are front- heavy and often perched on small lightweight bases. To carefully secure your TV you can secure it with a Prograde Flat Screen TV Lock.?($29.32 on Amazon.com).

2. Protect?your components
All those flashing lights, sliding trays, and buttons ? how they love buttons ? make components like Blu-ray players, DVRs, cable boxes and iPod docks very tempting for sticky fingers. You can get an entertainment unit that holds your TV and electronics, with glass or frosted doors that close, like the TOBO TV panel with media storage ($319 on?Ikea.com). You can secure the doors with childproof locks and secure the unit to the wall. Most remotes will work through glass.

Sewell

For those that don?t work through glass, or if your unit has wooden doors, you can get an external remote sensor like the Sewell InjectIR ($44.95 on Amazon.com) that sees IR commands from all of your remotes and transmits them to your components via HDMI (see the illustration).

You can also get a clear plastic shield that covers the front of your components. The DVD/Stereo Guard by Parent Units ($12.74 on Amazon.com) keeps wee hands from pushing buttons, but is easily removable for adult access.

3.?Cover your outlets and power strips
Though the standard plug covers are quite handy and inconspicuous for plugs you rarely use, they are finger-breaking to remove. A product like the Kidco Outlet Plug Cover ($7.25 on Amazon.com), keeps kids off of the plug, allows you to shorten the cord and it?s easily opened for use. Since most of us are plugging in our entire lives, power strips are an issue as well. A Power Strip Cover from Safety 1st ($7.99 on Amazon.com) keep curious hands from yanking at the plugs.

Wiremold

4. Organize your wires
Hide cords behind cord concealers like the Wiremold CordMate II Cord Organizer ($24.99 on Crutchfield.com) if you?re running cables along a wall. Directly behind the TV, manage cables with zip ties or cover them with a wrap like the Monster Cable-It Wire Management System, which comes in three colors and several lengths ($12.20 for 8 feet on Amazon.com).

5. Protect your remote control
The most oft-dropped item deserves a little protection too. A Remote Control Cover from Remote Wraps ($15.99 on RemoteWraps.com) protects the device, the device?s battery door, and your furniture from getting banged up.

There are many baby-proofing companies that will come in to your home and assess your needs. Make sure when researching a company that they provide full service for home theaters, and not just plugs and cords.

How To Look For Online Weight Loss Help | New Health and Fitness

New Health And Fitness.Org - Health Information You Can Use

When doing a search for online weight loss help one will yield close to 117,000,000 results. These results will include everything from fad diets that guarantee you will lose 10 pounds in 5 days to long term eating plans that may or may not work. Each site you stumble upon promises bigger, better, faster, and more effective strategies for dropping weight. The question is who to listen to and which ones work.

When it comes to dropping extra pounds, everyone has an opinion or idea they want to share, whether it be granny?s liquid concoction or the gym addict?s 4 hour per day workout. The biological make up of the human body however, does not cope well with fad diets and shock therapy. This advice may work for a short while, but later result in one picking up the weight all over again.

If deciding on the the internet as a route to follow, try to find a diet and exercise plan that can fit into an average day-to-day lifestyle. A plan that is easy to follow is one that includes easy-to-cook meals that are easy to keep eating. When looking for a trainer on the Web, make sure that the trainer chosen is willing to work at a beginner?s pace and has experience at working with inexperienced athletes. It is a good idea to look at the testimonials of previous clients.

Look for websites that are highly rated and broadly followed. It is a good idea to locate a forum to join. This way one is able to speak to other dieters who are struggling with the same challenges. Alternatively, find an online trainer who can be a support.

A good option is to consult a health or lifestyle magazine site. These websites offer responsible and reliable advice on diet and exercise. Often, these websites provide exercise plans for inexperienced athletes and healthy recipes to make dieting easier. Online magazine sites also usually provide someone to speak to for more information.

Remember, even though the promises made when searching for online weight loss help are alluring, many are not healthy and will result in an increase in weight in the long term. Look for websites that are trusted and well reviewed. Be patient and enjoy the slow changes that come with the correct help and advice.

Bayo Olukotun: Supercross Moves East

For someone new to the sport, it might seem like the entire Monster Energy AMA Supercross series takes place in the Southwest. Fortunately for the rest of the moto-starved country, that is not the case. For round seven, the series finally heads East-ish to Dallas, Texas. Last week in San Diego, Ryan Villopoto reclaimed the points lead in the premier class and now leads by three points over Chad Reed. James Stewart fumbled in the whoops, and may very well have taken himself out of the championship chase. Eli Tomac also crashed in the whoops during the West Lites main event, and in doing so, tightened up the points chase by allowing Dean Wilson to runaway with the win. But the West riders now take a long break as the East riders have their opening race in the Lone Star State.

The East Lites series, like last year, is set to have a field of some very fast and talented riders. Some are rookies, some veterans, and one is the defending champ. Here are my top five major players:

Justin Barcia

Justin Barcia is going to be a very tough competitor. The guy who has come to be known as Bam Bam is not afraid to get physical, and his aggression and attitude harken back to the early days of American motocross. Last year he found a way to calm down his mid-flight over revs and work on his timing and patience. It was not a flawless series for the GEICO/Honda rider, but he prevailed in the end with a number one plate. There has not been much word from the Barcia camp in the off-season, and from a rider of his caliber, that usually means he has been putting in the hard work to come out swinging in Dallas.

Blake Baggett

Last year, Blake was a revelation both indoors and out. The former amateur star had a mixed start to his professional career back in the 2010 when he managed to win the Houston round of Supercross. When he broke his arm at Budds Creek, it ruined his momentum and took him out for the remainder of the year.

When Baggett returned to racing for 2011, he was put on the Monster Energy/Pro Circuit/Kawasaki team and began to deliver almost immediately. A few top three results before decimating the rest of the field at Daytona set Blake apart as one of the few riders who would be a threat at every round. Although the championship eluded him in Supercross and the Nationals, Baggett has proven to be one of most fit and fast riders on the track on any given day. El Chupacabra will be ready to come out of the dark on in Texas.

Ken Roczen

What can be written about the German wunderkid that has not already been put into ink? Beyond his accomplishments (youngest rider ever to win a World Motocross GP at 15 years old; 2011 FIM World Motocross MX2 Champion; 2010 and 2011 Motocross of Nations MX2 Champion), Roczen represents a new generation of riders. His style is a near carbon copy of James Stewart's, his attitude is that of a German Travis Pastrana, and his desire to win at the highest level rival's that of Ricky Carmichael and Stefan Everts.

Last year, Ken arrived on American shores with minimal Supercross experience. By the time the series ended in Las Vegas, he was a constant podium threat and actually won his first main event that very night. The Red Bull/KTM star was supposed to ride the West Lites series but broke his arm only a few weeks before Anaheim I. Now with only a few weeks of riding under his belt, he is will be facing some stiff competition in the East. At all of 18 years old, he will probably not hold back much from the series start. The biggest threat that Roczen brings is that he, like Barcia, knows how to win a championship points battle.

Darryn Durham

Some riders use their strength to ride. For others it comes down to attitude. For Durham, there is no hiding his natural ability on a motorcycle. Where others can make a section look scary, exhausting, or even easy, Darryn will make it look fun. The Pennsylvanian has been riding the East series for several seasons now, but he's had very little success. In his rookie season, he had a decent factory supported ride, but lost it at the end of the year. No big teams picked him up in 2010 or 2011, so he was forced to go the partially-supported privateer route. But he continued plugging away and finally found his stride in the 250 Outdoor Nationals. Aboard off-the-shelf equipment, Durham showed that he could run the pace of the top riders in the world at several rounds of the tour.

This was enough to gain the attention of the most successful team in 250 motocross: Monster Energy/Pro Circuit/Kawasaki. Durham, like Roczen, had a preseason injury that delayed his training. Now Durham should be healed up and ready to take on a championship run. Considering what he accomplished as a privateer, it would be a safe bet to keep an eye on the number 35 machine when the gate drops in Dallas.

Kyle Cunningham

Professional careers rarely go as planned, and for a while, it seemed that Cunningham's was moving in the wrong direction. With a similar path as Durham, Kyle was a top amateur racer who was awarded a factory supported ride in his rookie year with the now defunct Yamaha of Troy team. But it was not the best of years and he was forced to go it alone in 2008. He pushed and struggled and by the time the Nationals were over, he had finished seventh overall for the year as a privateer. Since then Cunningham has regained favor with factory supported teams and he most recently joined the Star/Valli/Yamaha effort in 2011, delivering some excellent rides along the way.

Coming into 2012, Cunningham is looking stronger and faster than ever. Sporting the number 19 machine, Kyle will be there every weekend. If he can get win number one out of the way, he could very easily become a championship threat.

The Rookies

Justin Bogle - The Okie is the latest graduate of GEICO/Honda's amateur-to-pro-team program, and he has already produced results. A sixth overall wasn't too shabby in his pro debut at the Unadilla National in 2011. He then capped off the season by leading almost the entire last moto of the year at Pala before settling for second. Justin has been putting in the laps around Southern California's Supercross practice tracks all winter long and is looking very fast and comfortable. Bogle will be a threat right from the start.

Kyle Peters - Peters is another graduate of an amateur-to-pro-team program, but in this case with Star/Valli/Yamaha crew. Kyle had a minor injury that delayed his pro debut until the final two rounds of the 2011 Nationals, and the results were not quite what he was looking for. As another Loretta Lynn's stand out, Peters certainly has the talent and speed to run up front. Whether or not he has adapted to the tight confines of Supercross remains to be seen but we will see soon enough.

Be sure to check out the Dallas Supercross live on SPEED beginning at 8:30pm EST.
